Question from Sub to GCs: Do any of you have Master Contracts/Agreements in Place with Your Regular Subcontractors?

So, we are a commercial MEP subcontractor.  We currently utilize a master service agreement with our subcontractors, with a project-specific contract for any hired work.  Our view is that this enables us to have a standard agreement in place with anyone that performs work for us agreed to ahead of time, thus making the project-specific contract (and any negotiations) more efficient.

We'd like to now start doing the same with our GCs:  having a standard agreement in place, with project-specific agreements, as well.  Do any GCs currently have agreements like this in place with your subcontractors?  If so, have you seen this be productive arrangement for both parties?

Each contract is unique to the project for which it is written. Master contracts create ambiguity and are mostly one-sided. Even though I've signed a few, I always reserve the right to renegotiate when issued a subcontract for a particular project. In order for contracts to be successful, they must keep the interests of the parties aligned. Where one party seeks to gain an advantage over another is detrimental to the relationship. More GC's should realize that their sub is their partner, not their adversary. Those that seek to restrict the rights and the performance get what they deserve. Remember, a rising tide float floats all ships!
