He doesn't qualify as the guidelines state employees are eligible after 30 days of employment. Plus you're only subject to the FFCRA if your company has less that 500 employees.
That being said, if you end up in this situation again, you can take the deduction on your next tax deposit. I just completed our 2nd Qtr 941 and somehow hadn't calculate the employer SS deduction credit correctly. So my 941 showed a credit due. The credit was taken on our next week's tax deposit.
