Certified Payroll Bi-weekly payroll

    Hello,

    I have only ever done Certified Payroll for weekly pays, but the company is switching to a bi-weekly. How would that reflect on a certified payroll report?

    Christine,

    You may want to review the Davis Bacon act or the state laws where you operate. The Davis Bacon Act requires pay at least once a week (see 40 U.S. Code @ 3142 (c) (1)). Some contractors pay on multiple pay schedules, i.e. office staff is paid monthly or bi-weekly and craft workers are paid weekly. The extra effort to pay on multiple schedules may not be worthwhile.

    It is my understanding that certified payroll is required to be reported weekly.  Even if you pay biweekly.  I believe that it also requires weekly payments to those workers who are covered by the Davis Bacon or other prevailing wage.  I realize that many jurisdictions have their own guidelines and I am not aware of those specific guideline however the AGC has published An Industry Guide to Understanding Federal Prevailing Wage Law.  It is a very useful tool and it states that the Davis Bacon act require weekly payment of wages and posting of wage rates.
